1. Acceptance of Terms
By accessing or using CartJockeys Scheduler ("CartJockeys," "the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of CartJockeys constitutes acceptance of any updates or modifications to these Terms.
2. Description of Service
CartJockeys is a workforce scheduling and communication platform designed for golf course operations. The Service provides shift scheduling, employee availability management, broadcast messaging, policy distribution, and related workforce coordination tools. The Service is provided to employees and administrators of participating organizations.
3. User Accounts and Access
- Accounts are created by organization administrators on behalf of employees.
- Workers access the Service through unique token-based links provided by their employer. You are responsible for keeping your access link confidential.
- Administrator and supervisor accounts are protected by email and password credentials. You are responsible for maintaining the security of your login credentials.
- You must not share your access credentials or token links with unauthorized individuals.
- You must notify your administrator immediately if you believe your account has been compromised.
4. Acceptable Use
You agree to use CartJockeys only for its intended purpose of workforce scheduling and communication. You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service.
- Interfere with or disrupt the integrity or performance of the Service.
- Transmit any harmful, threatening, abusive, or otherwise objectionable content through the messaging features.
- Use the Service to send unsolicited messages or spam.
- Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission.
5. SMS Messaging Terms
- By providing your phone number, you consent to receive SMS messages from CartJockeys related to your employment, including schedule notifications, availability requests, broadcast messages, and policy updates.
- Message frequency varies based on scheduling activity and organizational communications.
- Standard message and data rates from your wireless carrier may apply.
- You may opt out of non-essential SMS communications by contacting your administrator. Note that opting out of all messages may affect your ability to receive critical scheduling information.
- SMS messages are sent via Twilio, a third-party messaging service. By using this Service, you also agree to Twilio's acceptable use policies.
- We are not responsible for delays or failures in SMS delivery caused by carrier networks or third-party services.
6. Availability and Scheduling
- You are responsible for accurately submitting your availability through the Service by any deadlines set by your organization.
- Published schedules are for informational purposes through the Service. Your employer retains the right to modify schedules as needed.
- CartJockeys is a scheduling tool and does not constitute an employment agreement or guarantee of hours.
7. Intellectual Property
The Service, including its design, features, and content (excluding user-submitted data), is the property of CartJockeys and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during the term of your employment with a participating organization.
8. Account Deactivation and Termination
- Your organization's administrators may deactivate or terminate your account at any time, with or without cause.
- Deactivated accounts may be reactivated at the discretion of the organization.
- Upon termination, your access to the Service will be revoked, but historical scheduling and communication records may be retained for operational purposes.
- We reserve the right to suspend or terminate accounts that violate these Terms.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURSECREW AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR EMPLOYMENT OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOUR ORGANIZATION FOR USE OF THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless CartJockeys, its operators, and affiliated parties from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Davis County, Utah.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via SMS notification. Your continued use of the Service following any changes constitutes acceptance of the revised Terms.
